New Emission Limits for Small and Medium Combustion Installations Enter into Force

On 22 March 2010 an amendment of the German Small and Medium Combustion Installation Ordinance (Verordnung über kleine und mittlere Feuerungsanlagen – 1st BImSchV) enters into force. E.ON Suffers Setback in Legal Dispute Over Coal-fired Power Plant in Datteln

The Federal Administrative Court (Bundesverwaltungsgericht – BVerwG) dismissed E.ON AG’s complaint against the denial of leave to appeal against a ruling of 3 September 2009 by the Higher Adminstrative Court in Münster (Oberverwaltungsgericht Münster – OVG) in which the OVG revoked the zoning plan (Bebauungsplan) for an area in Datteln on which E.ON wants to build a new hard coal-fired 1050 MW power plant, due to start operations in 2011.
