Court of First Instance Annuls Commission Decisions on Allocation Plans for Poland and Estonia

In two judgments on 23 September 2009, the European Court of First Instance annulled Commission Decisions concerning the National Allocations plans (NAPs) for emissions allowances for the Republics of Poland and Estonia for the period from 2008 to 2012.
The Court considered that by imposing, in its review of NAPs, a ceiling on emission allowances to be allocated, the Commission exceeded its powers.
