Clearingstelle EEG Initiates Biomass Bonus Consultation

The Renewable Energy Act (EEG) provides for a  bonus of 3 Cent/kWh on top of the standard biomass feed-in tariffs if the electricity is generated from renewable resources or manure (Section 27 para 4 no. 2 EEG). Clearingstelle EEG (EEG Clearing Agency) recently initiated an advice procedure (Hinweisverfahren) with respect to the interpretation and interplay of the applicable bonus provisions.

EEG Clearing Agency is an independant body established by the Ministry for the Environment, Nature Protection and Nuclear Safety that serves interested parties with regard to the interpretation and disputes relating to the EEG. To this end, the agency can initiate different proceeding, one of which is the “Hinweisverfahren” (advice procedure).

Associations, lobby groups and public authorities listed the code of procedure of EEG Clearing Agency are asked to comment on the following two questions raised by EEG Clearing Agency by 8 November 2010.

Firstly, EEG Clearing Agency wants to determine whether substances listed in a positive list in Annex 2 III EEG also have to fulfill the criteria of the general clause of Annex 2 II no. 1, which defines renewable resources in the sense of the EEG.

Secondly, EEG Clearing Agency wants to determine whether substances listed in the negative list in Annex 2 IV cannot receive the biomass bonus of Section 27 para 4 no. 2 EEG even if they fall under the general clause of Annex 2 II no. 1.

In its recently presented Energy Concept, the government announced to review the numerous bonuses in the EEG.
