BMWi Presents Key Points of New Regulatory Framework for Distribution Grid Operators

The Federal Ministry for Economic Affairs and Energy (BMWi) has presented key points for a “Modern Regulatory Framework for Modern Distribution Networks”, the core element of which is an amendment of the Incentive Regulation Ordinance (ARegV). A focus lies on improving investment conditions and energy efficiency. The planned amendment is particularly relevant for future renewables growth, as about 80% of the electricity generated by renewable power plants is fed into the distribution networks. With the growing amount of renewable energy in Germany this creates the need to invest in the distribution networks to equip them for Germany’s energy transition (Energiewende).

Revision of Several Grid Ordinances Promulgated, Including Grid Fee Amendment for Large Electricity Consumers

An ordinance amending the electricity and gas grid charges ordinances (StromNEV and GasNEV), the Incentive Regulation Ordinance (ARegV) and the Electricity Grid Access Ordinance (StromNZV) has been published in the Federal Law Gazette of 21st August 2013. The amendments include changes to the network charges for large electricity consumers.

Federal Cabinet Adopts Bill Amending Electricity and Gas Grid Charges Ordinance and Incentive Regulation

The Federal Cabinet last week adopted a bill for an ordinance amending the electricity and gas grid charges ordinances (StromNEV and GasNEV), the Incentive Regulation Ordinance (ARegV) and the Electricity Grid Access Ordinance (StromNZV). An important aspect is a retightening of Section 19 Abs. 2 StromNEV, which provides for the exemption of large electricity consumers from network charges since 2011.

8th Meeting Future Proof Energy Networks Platform

The 8th meeting of the ”Future Proof Energy Networks Platform” (Plattform Zukunftsfähige Energienetze) focused on the regulatory framework for distribution networks.  A paper on key findings also provides information the progress made towards grid expansion.

Ordinance on Grid System Stability Requiring Retrofitting of PV Plants Entered Into Force

On 20 July the System Stability Ordinance entered into force. Under the new Ordinance operators of distribution grids have to retrofit photovoltaic plants within three years by specialised firms to minimise the 50.2 Hertz problem.

BNetzA Specifies Procedure for Data Collection for 2nd Regulation Period for Grid Charges in Electricity Sector

The German grid regulator, the Federal Network Agency (BNetzA) determined the procedure for collecting the data concerning the cost verification of the operation of electricity grids. The data is needed to establish the base level for setting the revenue caps on grid charges for the second regulation period pursuant to Incentive Regulation Ordinance (ARegV). The decisions handed down apply to the states of Thuringa, Berlin, Brandenburg, Bremen, Mecklenburg Western-Pomerania, Lower Saxony, Schleswig Holstein and the federal territory (Bundesgebiet). The second regulation period in the electricity sector starts 2014.

BNetzA: Calculation Methods for Capital and Operating Costs Pursuant to Section 23 ARegV

The fourth Ruling Chamber (BK4) of the Federal Network Agency handed down a decision (ref. no. BK4-12-656) on calculation methods for capital and operating costs resulting from approved investment budgets in the sense of Section 23 Incentive Regulation Ordinance (ARegV). The decision is addressed to operators of gas and electricity grids. It applies to costs becoming effective in 2012.

BNetzA and Grid Operators Reach Agreement for ARegV Investment Budgets

The German grid regulator, the Federal Network Agency (BNetzA) and reportedly 38 grid operators have reached a settlement regarding investment budgets pursuant to the Incentive Regulation Ordinance (ARegV), which determines the revenue caps for the grid fees German network operators can charge.
