BNetzA and BKartA Publish Update of Joint Guideline for Electricity and Gas Concession Agreements

The Federal Network Agency (BNetzA) and the German Cartel Office (BKartA) have published an update of their joint guideline on electricity and gas concession agreements between municipalities and utilities for the use of public property when laying and operating power and gas lines. The update was necessary in view of legislative changes. It also takes new case law into account.

Updated VKU/DST/DStGB Brochure on Concession Agreements

The Association of German Municipal Enterprises (VKU), the German Association of Cities (DST) and the German Association of Towns and Municipalities DStGB) have presented the update of their jointly published broschure on concession agreements. The brochure is intended to provide support and guidance for municipalities and municipal companies.

German Cartel Office Decision on Tendering Process for Gas Concession in Markkleeberg

After proceedings by the German Cartel Office that considered the tendering process for the gas concession in Markkleeberg near Leipzig in Saxony unlawful, a new tendering process will take place. The town of Markkleeberg already committed itself to restarting the tendering process, following a proposal from the Cartel Office for a fair and transparent procedure. Hence, the Cartel Office closed the proceedings.

Electricity and Gas Concession Agreement Guideline Issued by Federal Cartel Office and Federal Network Agency

Many of the about 20,000 gas and electricity concession agreements between municipalities and utilities for the use of public property are about to expire. A new Joint Guideline by the Federal Cartel Office and the Federal Network Agency shall provide guidance for new concession agreements, particularly in light of recent remunicipalisation developments.

New Era of Energy Remunicipalisation?

In the early nineties municipal energy supply was considered a burdensome and costly service by many municipalities. Hence, many of them outsourced the energy supply to private companies. Now, as many concession agreements with private utilities are about to expire, municipalities are reconsidering a remunicipalisation of the grids. Many municipalities are again thinking that energy and investments in its infrastructure are an attractive source of income, providing stable yields. BGH: Obligation to Transfer Gas and Electricity Grid after End of Concession

Energy utilities are obliged to comply with previous contractual agreements to transfer ownership for local gas and electricity grids when the concession ends, the Federal Court of Justice (Bundesgerichtshof – BGH) decided on 29 September 2009.
