OLG Düsseldorf: DB Energie Must Provide Access to Site Networks

During an oral hearing on Wednesday, the Higher Regional Court of Düsseldorf (OLG Düsseldorf) indicated its willingness to essentially confirm a decision by the Federal Network Agency (BNetzA) ordering DB Energie GmbH to provide grid access for third parties supplying energy to end customers connected to its grid, BNetzA informed. As a result, DB Energie GmbH withdrew its appeal.

BGH: DB Energie Obliged to Seek Approval of Grid Access Charges

The Federal Network Agency (Bundesnetzagentur), the German grid regulator, informed about a still unpublished ruling by the Federal Court of Justice (Bundesgerichtshof – BGH). The BGH ruling confirmed a decision by the Higher Regional Court  of Düsseldorf according to which DB Energie GmbH, a subsidiary of Deutsche Bahn (German Rail), has to seek approval of transmission grid access charges with the Federal Network Agency.

Federal Network Agency Orders DB Energie to Provide Grid Access

The Federal Network Agency (Bundesnetzagentur), the German grid regulator, ordered DB Energie GmbH, a subsidiary of Deutsche Bahn (German Rail) to provide grid access for third parties supplying energy to end customers connected to its grid by 1 February 2011 at the latest.
