Revision German Renewable Energy Sources Act – BMWi Starts Consultation on Draft EEG 2016

The Federal Ministry for Economic Affairs and Energy has started the consulting process on the 2016 revision of the German Renewable Energy Sources Act EEG. With this bill the government will use auctioning as the standard system to establish support levels for renewable energy, starting mainly in 2017.

New PV Capacity in July 2015 Rises to 159.780 MWp – Total PV Capacity Promoted by EEG Amouts to 39 GWp

pIn July 2015 new PV capacity in the amount of 159.780 MWp was installed, bringing solar capacity eligible for support under the Renewable Energy Sources Act (EEG) to a total of 39,009 MWp by the end of the month, the Federal Network Agency (BNetzA) reported.

German PV Additions of 95.5 MWp in June – 38.9 GWp Eligible for EEG Support

PV capacity additions in June 2015 amounted to 95.502 MWp. By 30 June 2015, a total of 38,850 MWp of solar capacity were eligible for support under the Renewable Energy Sources Act (EEG), the Federal Network Agency (BNetzA) reported.

BVerwG: EEG Surcharge Limitation under EEG 2009 Only for Independent Business Units with Market Activity – Situation under EEG 2014

Two recent rulings by the Federal Administrative Court (BVerwG) have clarified the requirements under which independent business units of manufacturing companies could apply for a limitation of the surcharge paid on electricity in support of renewable energy sources (EEG surcharge) under the Renewable Energy Sources Act 2009 (Section 41 para. 5 EEG 2009).

BMWi Presents Key Point Paper for German Renewable Energy Auctions in 2017 and Launches Consultation

The Federal Ministry for Economic Affairs and Energy has presented key points for auctioning financial support for onshore and offshore wind power and photovoltaics as of 2017 and launched a consultation. Comments have to be submitted by 1 October 2015.

BNetzA: New PV Capacity of 101,483 MWp in May 2015 – Financial Support for New Installations Reduced by 0.25%

With a total of 101,483 MWp, new PV capacity installed in May 2015 in Germany basically remained on the same level as in the previous months. Solar capacity eligible for support under the Renewable Energy Sources Act (EEG) reached a total of 38,754 MWp by the end of May. The monthly reduction of financial support for new PV installations has been reduced to 0.25% each month in the period from 1 July to 1 September 2015, the regulator, the Federal Network Agency (BNetzA) informed.

Bundesrat Clears Second Act Amending the Renewable Energy Sources Act (EEG 2014)

In its session on 12 June 2015 the Federal Council did not object to the “Second Act Amending the Renewable Energy Sources Act”, which extends the possibility to claim a reduction of the Renewable Energy Surcharge to more energy-intensive industries and corrects an uncertainty that has arisen under the Renewable Energy Sources Act 2014 (EEG 2014) with regard to financial support for renewable power plants that use a shared meter.

97.677 MWp: PV Growth Remains on the Level of the Previous Months

With new PV capacity of 97.677 MWp added in April 2015, solar growth remains on the level of February and March. PV capacity eligible for support under the Renewable Energy Sources Act (EEG) totalled 38,653 MWp by the end of April, the regulator, Federal Network Agency (BNetzA), reported.

Article on 2014 German Renewable Energy Sources Act Revision Published

Our article “The 2014 German Renewable Act revision – from feed-in tariffs to direct marketing to competitive bidding” has just been published online in the Journal of Energy & Natural Resources Law (JENRL). On 16 pages (with lots of footnotes), the article describes the major changes to the German support system for renewable energy sources following the 2014 revision of the German Renewable Energy Sources Act (EEG 2014).
