BNetzA and BKartA Publish Update of Joint Guideline for Electricity and Gas Concession Agreements

The Federal Network Agency (BNetzA) and the German Cartel Office (BKartA) have published an update of their joint guideline on electricity and gas concession agreements between municipalities and utilities for the use of public property when laying and operating power and gas lines. The update was necessary in view of legislative changes. It also takes new case law into account.

President of German Cartel Office Calls for Reform of Renewables Law and Questions Feed-in Priority

Andreas Mundt, President of the German Cartel Office, has demanded a fundamental EEG reform in the near future in an interview with Handelsblatt. Renewable energy production was completely regulated, but without rhyme or reason, he said. In the interview he also indicated that the feed-in priority for renewables under the current EEG could be abolished.

BNetzA and German Cartel Office Present Joint Electricity and Gas Monitoring Report 2012

The Federal Network Agency (BNetzA) and the German Cartel Office presented their first joint Monitoring Report 2012 of the developments in the German gas and electricity markets yesterday. It documents the developments in the German energy markets in 2011, the year Germany decided to phase out nuclear power while further pursuing its course towards renewable energy supply.

German Cartel Office Still Cautious with Market Definition in Gas Market, But Clears Merger of Regional Gas Supplier ESW Gas

A decision (ref. no. B8 124/11) taken by the German Cartel Office in March, clearing the merger of  ESW GasVertrieb GmbH (ESW Gas) with Energie Südwest AG (ESW AG), is now available online. The decision was taken following a review by the Cartel Office, as the majority shareholder of ESW AG is Enovos Deutschland AG (Enovos), the established transnational gas supplier in the German state of Saarland, southern Rhineland-Palatinate and Luxembourg, which was formed by a merger of Saar Ferngas and two electricity and gas companies from Luxembourg.

German Cartel Office Issues Decision Against Entega Ordering Refund of EUR 5 Million to Customers

The German Cartel Office issued a decision against the Darmstadt based utility Entega, ordering the company to refund customers supplied with electricity for night storage heaters and heat pumps with a total of approximately EUR 5 million. The decision is based on an investigation of heat energy prices that Entega charged household customers and small-sized commercial customers between 2007 and 2009. The Cartel Office came to the conclusion that they were abusively excessive.

Federal Cartel Office Clears 24% RWE Stake in Stadtwerke Unna

RWE AG (RWE) has been granted clearance for its 24% stake in the municipal utility Stadtwerke Unna GmbH (SWU) by the Bundeskartellamt (German Federal Cartel Office), following a detailed examination pursuant to the merger control regulations of the German Act against Restraints on Competition (GWB). Bundeskartellamt held that the merger did not reinforce RWE’s position in the electricity markets.
