TSOs Publish § 19(2) StromNEV Grid Surcharge for 2015 to Compensate for Individual Grid Charges

The German transmission system operators (TSOs) have published the electricity grid surcharge for 2015 pursuant to Section 19 para. 2 StromNEV (Electricity Grid Charges Ordinance – StromNEV). The 2015 grid surcharge will also be used to settle grid charge changes dure to a regulatory amendment of the StromNEV in August 2013 that affected the surcharges for 2012 and 2013.

TSOs Publish Partly Lower Electricity Grid Surcharge for 2014

The German electricity TSOs have published the so-called Section 19 para. 2 StromNEV electricity grid surcharge for 2014. Following regulatory amendments in August 2013 that also affects the 2012 and 2013 surcharge it is lower than the 2013 surcharge for one consumer group.

Revision of Several Grid Ordinances Promulgated, Including Grid Fee Amendment for Large Electricity Consumers

An ordinance amending the electricity and gas grid charges ordinances (StromNEV and GasNEV), the Incentive Regulation Ordinance (ARegV) and the Electricity Grid Access Ordinance (StromNZV) has been published in the Federal Law Gazette of 21st August 2013. The amendments include changes to the network charges for large electricity consumers.

Cabinet Approves Changes for Network Charges for Large Electricity Consumers and Revision of Incentive Regulation

Today the Federal Cabinet finally approved changes to the network charges regime for large electricity consumers. The Federal Council had already approved the revision, on 5 July 2013, subject to certain conditions, which the Cabinet accepted. The revision shall address concerns raised by the European Commission and German courts.

OLG Düsseldorf: Court Revokes Federal Network Agency Decision on Grid Costs

In 19 test cases the Higher Regional Court of  Düsseldorf (OLG Düsseldorf) revoked decisions by the Federal Network Agency (BNetzA) on grid fees charged by gas and electricity network operators. The cases hinged on the proper calculation of admissible costs that network operators can include, especially with regard to prices and wages concerning the construction of power lines and installations and with regard to the productivity sector used by BNetzA.

OLG Düsseldorf: Verdict on Higher Grid Charges in June

Almost 300 gas and electricity network operators appealed the decisions on grid charges by the Federal Network Agency (BNetzA), claiming higher grid charges. Last week the Higher Regional Court of  Düsseldorf (OLG) held oral proceedings in 19 pilot cases.

BNetzA Reported to Expect Rising Electricity Costs Due to Higher Grid Costs

The German Grid Regulator (BNetzA) expects electricity cost to rise as the need for an expansion of the German grids will drive up costs, the newspaper Frankfurter Allgemeine Zeitung (FAZ) reports.

X Factor: BGH Confirms EnWG and Incentive Regulation Ordinance Amendment

In a decision of 31 January 2012, the Federal Court of Justice (BGH) ruled that last year’s amendments of Section 21a German Energy Act (EnWG) created the necessary legal basis for a general sector-related productivity rate (so-called X factor or Xgen) in Section 9 of the Incentive Regulation Ordinance (ARegV).

X Factor: Bill for General Sector-related Productivity Rate Factor Passes Federal Council

The Bundesrat (Federal Council) did not exercise its constitutional right to object against an amendment of the German Energy Act (EnWG) that will create the statutory basis for a general sector-related productivity rate (so-called X factor or Xgen) in the Incentive Regulation Ordinance (ARegV).
