The Bonn Regional Court (LG Bonn) dismissed EnBW’s compensation claim against the Federal Republic of Germany and the State of Baden-Württemberg. EnBW had asked for EUR 261 million because of the temporary unlawful moratorium shutdown of the Neckarwestheim I and Philippsburg I nuclear power plants.

EnBW plans to (also) file a lawsuit to claim damages for the 2011 German nuclear power moratorium, the company reported today. Damages are reported to have been in the range of a low triple digit million Euro figure.
Reportedly E.ON has filed lawsuits claiming damages of approximately EUR 380 million because of the shutdown orders for its nuclear power plants Unterweser and Isar 1 that were issued as part of a 3-month moratorium on nuclear power in Germany in the wake of the Fukushima nuclear accident in Japan in 2011.
According to various media sources, E.ON AG lodged a constitutional complaint with the Federal Constitutional Court (BVerfG) alleging an infringement of its fundamental rights due to the uncompensated shut down of some of its nuclear power plants under a 3 Month Moratorium for German Nuclear Power Extension and the following restriction of the operating times as part of the accelerated nuclear power phaseout.
The four German TSOs have indicated that the nuclear power moratorium is having a significant impact on the German electricity supply system. Sufficient security of energy supply may not be guaranteed in southern Germany on very cold winter days with concurrent low wind power generation.
RWE AG has brought legal action against the interim decomissioning order of the supervisory authority in Hessen for its Biblis nuclear power stations.
Chancellor Angela Merkel has announced to set up a new ethics commission for secure energy supply to assess ethical questions of the future of nuclear power. The commission’s findings shall supplement the work of the Reactor Safety Commission (RSK). As part of the 3-month moratorium on the recently decided nuclear power extension, the new Ethics Commission shall provide input to the government’s risk assessment of nuclear power generation.
Dr. Norbert Lammert, President of the German Parliament (Bundestag), told the newspaper Berliner Zeitung that he wanted the Bundestag administration to examine whether the moratorium on the recent nuclear power extension had to be approved by parliament. Questions have also been raised about the legal basis for the request to shut down the seven nuclear power plants.
