BVerfG: Application of Emission Allowance Reduction Factor to be Reviewed Again by BVerwG

The Federal Constitutional Court (BVerfG) on 10 December 2009 held that the Federal Adminstrative Court (BVerwG) has to review again the specific application of the reduction factor by the Federal Environment Agency (Umweltbundesamt) for the allocation of emission allowances granted under the Allowance Allocation Act 2007 (ZuG 2007). Commission: Poland and Estonia Currently Not Allowed to Issue Additional Emission Allowances

The EU commission is in the process of examing the rulings of the Court of First Instance (as of 1 December 2009 renamed to General Court) which lead to the annullment of Commission Decisions concerning the National Allocations plans (NAPs) for emissions allowances for the Republics of Poland and Estonia for the period from 2008 to 2012, EU Commissioner Stavros Dimas said.
