Bavarian Constitutional Court Clears 10H Minimum Distance Requirement for Wind Power Plants

The Bavarian Constitutional Court today decided that the controversial 10h minimum distance requirement for wind power plants in Bavaria is in line with the constitution. Pursuant to the so called 10h-regulation (10H-Regelung) contained in the revised Bavarian Building Code, wind power plants have to maintain a minimum distance from residential housing of ten times the total height of the wind power plant.

Bavarian Constitutional Court Hearing on Controversial 10H Minimum Distance Requirement for Wind Power Plants

On Tuesday, the Bavarian Constitutional Court heard the parties on the controversial 10h minimum distance requirement for wind power plants. BWE: Better Coordination Between Military Flight Operations and Wind Turbines

Following the evaluation of a pilot project by BWE members and the German Armed Forces at two military airports in the states of Mecklenburg-Western Pomerania and Schleswig-Holstein, the Federal Ministry of Defence agreed to the use of control technology for wind power plants, the German Wind Energy Association (BWE) announced. By using the control technology military flight operations and wind power turbines can be better coordinated.

BDEW: More Than 10 Billion kWh of Wind Power Produced in January 2015

With more than 10 billion kWh of wind power produced (including 0.2 billion from offshore wind) January 2015 saw a new record, beating the previous record of 9.6 billion kWh set in December 2014, the Federal Association of the Energy and Water Industry (BDEW) informed. This confirms earlier information by the Renewable Energy Industry Institute Münster (IWR). Wind power production in January already equalled roughly a fifth of the total wind power output in 2014, BDEW said.

Legal Action Against Bavarian 10H Minimum Distance Regulation for Wind Power

The German Wind Energy Association (BWE) has announced that its Bavarian section officially supports an lawsuit by Pro Windkraft against two recent minimum distant rules in the Bavarian Building Regulations (Bayerische Bauordnung). The articles challenged prescribe a minimum distance of wind power plants to residential housing of ten times the total height of the wind power plant. BWE also criticised the outcome of an energy dialogue organised by the Bavarian government which BWE thinks is likely to hinder further wind power growth, as Bavaria is questioning the planned expansion of the German transmission grids.

VDMA/BWE: 58% Onshore Wind Power Growth in 2014 – Net Growth of 4,386 MW Way Above EEG 2014 2,500 MW Target

In 2014 new onshore wind power turbines with a total capacity of 4,750 MW were installed, the German Engineering Federation (VDMA) and the German Wind Energy Association (BWE) informed. This exceeds the growth target of 2,500 MW net annually introduced with the amendment of the Renewable Energy Sources Act (EEG) that is effective since August 2014 (EEG 2014) by far. Even discounting a dismantling of some 364 MW net growth of about 4,386 MW remains 75% higher than planned.

OVG Schleswig Declares Amendment of Regional Plan 2012 Designating Areas for Onshore Wind Power Partly Invalid

Amendments of the Regional Plan 2012 for the State of Schleswig-Holstein in Northern Germany are invalid regarding the planning areas I and III that designate areas suitable for onshore wind power, the Higher Administrative Court of Schleswig -Holstein (OVG Schleswig) ruled. The Court found the amendments flawed for procedural as well as material reasons.

Information on Direct Marketing of Renewable Power in 2014 by TSOs – Highest Degree for Wind Power

An overview on direct marketing of renewable power by the operators in 2014 published by the four German transmission system operators (TSOs) shows that onshore wind power output has been mostly sold directly by operators and offshore wind power to a large extent by December 2014. Under the Renewable Energy Sources Act 2012 (EEG 2012) and the EEG 2014 that became effective as of 1 August 2014, operators can claim a market premium in addition to the sales revenue obtained (cf. Section 34 EEG 2014).
