Production and Wholesale of Electricity from Conventional Sources in Germany Exempt from Application of Public Procurement Directive 2004/17/EC

The European Commission on 24 April 2012 decided that Directive 2004/17/EC shall not apply to contracts awarded by contracting entities and intended to enable production and first sale of electricity produced from conventional sources to be carried out in Germany.

BDEW Rejects EU Plans for Directive on Concession Contracts

The Federal Association of the Energy and Water Industry (BDEW) dismissed EU plans for an obligation to conduct contract award procedures with respect to service concessions. The Commission’s proposals would restrict the freedom of the municipalities to act and thus violate Article 28 of the Basic Law (German Constitution), the association declared during a hearing regarding the matter held by the Federal Ministry of Economics and Technology. According to BDEW, the European Parliament also spoke out against the EU plans.

Sector Ordinance (SektVO) Changes Public Procurement Rules for Energy Sector

The Ordinance on Awarding Contracts in the Areas of Transport, Drinking Water and Energy Supply (Verordnung über die Vergabe von Aufträgen im Bereich Verkehr, der Trinkwasserversorgung und der Energieversorgung – Sektorenverordnung – SektVO) of 23 September 2009 was published in the Federal Law Gazette on 28 September 2009.
